Article: Case Against AIDS Scientist Dropped; Agency Decides Evidence Insufficient to Sustain Gallo Charges

The federal government yesterday dropped its charges of scientific misconduct against Robert C. Gallo, ending a long and acrimonious inquiry into the work of the co-discoverer of the AIDS virus.

The Office of Research Integrity (ORI) at the Department of Health and Human Services said it would have been "extraordinarily difficult" to defend against Gallo's appeal of the office's finding 13 months ago that he was guilty of misconduct. The three-member appeals board, scheduled to hear the case next week, in recent months has ruled that misconduct requires proof that a scientist willfully misstated research findings or conclusions.
