Federal judge rejects railroads' lawsuit against judges

A federal judge has rejected a lawsuit filed by four railroad
companies over a plan to group asbestos-related claims together in
class-action lawsuits.
Last week, U.S. District Judge John Copenhaver dismissed the
lawsuit filed by CSX Transportation Inc. of Jacksonville, Fla.,
Norfolk Southern Railway Co. of Norfolk, Va., Consolidated Rail Corp.
of Philadelphia and American Premier Underwriters Inc. of Cincinnati
against West Virginia's five Supreme Court justices and two circuit
judges.
The railroad companies, "have an adequate opportunity to raise
their constitutional challenges ... with the state trial courts and/
or the West Virginia Supreme Court," Copenhaver ruled.
