The Kentucky Attorney General issued the following open meetings decision:
In re: Jay McShurley/Somerset City Council
Summary: The Attorney General cannot ascertain the subjective intent of the council members in attending a series of less than quorum meetings. The record on appeal does not conclusively establish that the members attending those meetings collectively constituted a quorum. Nevertheless, we find that if a series of less than quorum meetings did, in fact, occur and the members attending those meetings collectively constituted a quorum of the council, the council's actions contravened KRS 61.810(2).
