The Kentucky Attorney General issued the following open records decision:
In re: John Hicks/Perry County School System
Summary: The Perry County School System City's failure to respond to the initial request was a procedural and substantive violation of the Open Records Act. The agency's response that affirmatively advised that requested records did not exist was in compliance with the Act and prior decisions of this office. The fact that records have been lost, misplaced, or destroyed suggests the presence of a possible management of records issue and this issue is referred to the Department for Libraries and Archives under authority of KRS 61.8715.
