Article: ATTORNEY GENERAL LYNCH: APPOINTMENT, MEMBERSHIP PROVISIONS OF COASTAL RESOURCES MANAGEMENT COUNCIL VIOLATE SEPARATION OF POWERS

The Rhode Island attorney general issued the following news release:

In a brief filed today with the Rhode Island Supreme Court, Attorney General Patrick C. Lynch states that the Coastal Resources Management Council's (CRMC) appointment and memberships provisions violate the Separation of Powers Amendment passed by Rhode Island voters on November 2, 2004, and are unconstitutional.

Lynch said that no changes to the composition or appointment authority have been made since the CRMC was created in 1971, when membership of the CRMC was established to consist of two members of the House of Representatives, two members of the Senate, and four public members appointed by the Speaker of the House. ...
