A police agency that complies with standards for investigating complaints against officers sustains qualified immunity against charges of freedom-of-speech violations, ruled the 8th Circuit Court of Appeals.
The court said the Missouri State Highway Patrol followed procedures in an investigation that led to the demotion and transfer of former Sergeant David Hughes.
Hughes brought a Section 1983 action MSHP Superintendent Roger D. Stottlemyre and other supervisors, claiming the sanctions were retaliation for his opposition to a consolidation plan.
