Article: COURT OF APPEALS UPHOLDS CITY CELL-PHONE SUIT

The city of Springfield issued the following news release:

The U.S. Court of Appeals for the Eighth Circuit in St. Louis today upheld a lawsuit filed by the cities of Springfield and Jefferson City seeking back taxes from cell-phone providers.

The lawsuit, originally filed in U.S. District Court in May 2004, was filed against a number of cell-phone providers who disputed that the City's six percent gross receipts tax on telephone and telephonic services applied to cell phones. The City sought five years of back taxes in the 2004 lawsuit. (The City of Jefferson City's claims were dismissed in this Appeals Court ruling because the companies have since settled with Jefferson City.)
