I.
INTRODUCTION
Just as the business world has learned to shift from typewriters to computers and from faxes to electronic mail, so must the transportation industry learn to manage the ever-evolving development of technology and the electronic data it creates. After several years of discussion and debate, the proposed changes relating to electronically stored information (ESI) in the Federal Rules of Civil Procedure took effect on December 1,2006. While these changes will impact every case in federal court and a vast majority of state court cases as well, they are certain to have particular impact on motor carriers as state legislatures adopt the new federal rule provisions in full or in ...
