I. INTRODUCTION
Air pollution regulation and remedies to the increasing problem of global warming are issues of vigorous debate today both in the international and political community, as well as in our own homes. However, air pollution regulation is not a new issue in American legal history. Interstate nuisance actions, like those involving air pollution, have been regulated by both common and statutory law since the early twentieth century.1 Despite this regulatory history, the phenomenon of global warming poses a new and challenging question to all three branches of government.
