Watertown mall's win in union-access case clarifies rules

WATERTOWN - Private property and business owners in New York, Connecticut, and New Hampshire now have a better idea of what criteria can be used to determine if a non-employee union organizer should be allowed on their property.

In a July 18 ruling, the U.S. 2nd Circuit Court of Appeals in New York City, which has jurisdiction over the three states, sided with the Salmon Run Shopping Center LLC in Watertown after it had refused to allow members of the Empire State Council of Carpenters Local 747 to distribute literature in the mall in October 2003.
