Steak n Shake Inc. might finally be headed for court.

Three years after soft-drink giant Pepsico Inc. filed a nearly $3 million breach-of-contract suit against the locally based diner chain, a trial date has been set for Oct. 26.

But it remains to be seen whether the case will actually go to trial as scheduled.

"There are a whole bunch of discovery disputes the court has not yet ruled on," said James R. Fisher, an Indianapolis attorney representing Consolidated Products Inc., Steak n Shake's parent. "If the court rules on them and we're able to complete our discovery, then we will be delighted to go to trial on that date."
