Class action certification hearings are scheduled for two lawsuits filed to determine whether insureds should be compensated for the decreased value of a vehicle after a crash.
Cases filed against State Farm Mutual Automobile Insurance Co. and Allstate Insurance Co. allege breach of contract and violation of the Illinois Consumer Fraud and Deceptive Business Practices Act. According to the lawsuits, the insurers have repeatedly refused to compensate their insureds for the decrease in value that results once a vehicle is damaged in an accident, and the policyholders believe they are entitled to additional damages for that diminished value (DV).
