Rules for Cooling Water Intake Structures

REGULATORY UPDATE

On July 9, the Environmental Protection Agency (EPA; Washington, DC; www.epa.gov) published a rule requiring certain existing power-producing facilities that employ cooling-water intake structures (CWIS) for cooling to control impingement mortality (immobilization of organisms against an intake screen), and, if appropriate, entrainment mortality (i.e., lethal effects due to passage of aquatic organisms into a cooling system) of wildlife. The rule, which goes into effect this month, applies to owners and operators of existing facilities (which includes those for which construction began on or before January 17, 2002) that meet all of the following criteria:
