An environmental group said Tuesday it plans to file a lawsuit against Xcel Energy (formerly Northern States Power Co.) for continued air pollution violations at its French Island waste-to-energy incinerator plant.
Wisconsin's Environmental Decade said the federal Environmental Protection Agency decided last fall that the incinerator must be upgraded, but Xcel has not yet corrected the problem.
"Unfortunately, EPA has not enforced the law they found NSP in violation of and a lawsuit may be the only way to bring the public health and economic benefits afforded by the Clean Air Act to La Crosse and western Wisconsin," said Keith Reopelle, the environmental group's program director.
