Business pursuits exclusion doesn't apply to libel suit

During a departmental meeting at a Pennsylvania university, a female professor circulated the results of an unauthorized student survey that was critical of a male professor. The woman was ordered to apologize to the professor during the meeting. The next day, she sent a memo to the dean of the university's business school alleging sexual harassment by the male professor.

The university found in its subsequent investigation that the professor was guilty of sexual harassment. He was ordered to watch rehabilitative tapes on the subject, and a letter summarizing the charges was placed in his personnel file.
