Article: Supreme Court Grants Review To 8th Amendment Test Of Lethal Injection

The Supreme Court has granted review to a technical question raised by a death row inmate who alleged Florida's chemical mix used for lethal injection violates the Constitution.

The Supreme Court will determine whether the lower courts incorrectly prevented the Florida death row inmate from pursuing a claim that lethal drugs cause excessive pain.

Should the court strike down lethal injection, the decision would not provide an approved alternative for 37 death penalty states and the federal government that use lethal injection.

But it appears more likely that the justices will allow the lower courts to wrestle with the issue.
