Prosecutor Seeks to Pull Kerik Lawyer - New York Times

A judge should consider removing the defense lawyer representing Bernard B. Kerik, the citys former police commissioner,because the lawyer might be called as a witness, federal prosecutors said yesterday in a request they sent to acourt. The United States attorney for the Southern District, Michael J. Garcia, asked Judge Stephen C. Robinson of United States District Court in White Plains to consider disqualifying the lawyer, Kenneth M. Breen, from representing Mr. Kerik. The prosecution also asked the court to appoint an independent counsel to advise Mr. Kerik of possible conflicts involving Mr. Breen and called for a hearing to ensure that Mr. Kerik is aware of any such conflicts.Mr. ...
